My Tenant Moved Out Without Permission

Recently my tenant moved out without notice, violating her lease terms. To justify her move, she provided a note from her doctor stating she should live in a smoke-free environment. She is in fact living in a smoke-free environment.

She is now threatening to sue me because my partner smokes. We live in the same building but our apartments are completely separate. The tenant admits to be ill before moving here and she left her last apartment because of illness.

I believe that she is a gold digger - She is either trying to avoid paying her rent or she wants to sue me for her medical maladies (she claims to have developed asthma).

thanks again for all the responses to 'tenant moved without notice.' i am lucky that she's gone and am very happy with the new tenant. what surprises me is all the illegal lengths people will go to in order to get something for nothing. the more i read, the more i realize that their are a lot of folks trying to 'game the system. what ever happened to honesty and hard work? evidently for some, those are values from the past. for those of us who do follow the rules, it's up to us to report abuses when we see them.

the title of that should have been without NOTICE. don't know how it got mistitled.

again, i'd like to thank everyone for their input. come to find out, the woman moved here to try to establish county residence in order to collect benefits. she'd been living in this county unofficially with her boyfriend, who gets disability checks and welfare. because of his welfare, she wouldn't tell where she really lived.

their attempt was fraudulent and my attorney assures me proper steps are being taken by the athorities. that's good enough for me.

on another subject, there are a lot of people around here who aren't looking for work and, at the same time, there are a lot of 'help wanted' signs. what's the deal with that? i wonder if we'll continue to have high unemployment rates as long as we continue to pay benefits. any feedback on that?

my attorney essentially told the old tenant to blow it out her rear. she, the old tenant, couldn't get anyone to represent her and was ordered by small claims court to pay three months rent even though she'd already moved. my new tenant has been here almost six months and says she's very happy here. we like her too.

You cannot "develop" asthma. You are born with it as part of your genetic makeup. There are many triggers to asthma; pets, cold weather, heavy exercise, or having the flu or a respiratory infection are common. A person can have an asthma episode / attack at any age. It can be prevalent in the early years, go away, then come back in the later adult years. Be thankful your bad tenant is gone; get a better one.
